Article 2- Subject
The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Turkish Commercial Code, Code of Obligations, Consumer Protection Law No. 6502, and the Regulation on Distance Contracts regarding the sale and performance of the accommodation service, the qualities and sales price of which are specified below, requested by the BUYER electronically from the sapancaohoibungalow.com website belonging to the SELLER.
The Buyer acknowledges and declares that they have been informed about the Seller's name, title, full address, phone number and other access information, basic qualities of the service subject to sale, sales price including taxes, payment method, delivery conditions and costs, etc., and all preliminary information about the service subject to sale, as well as the right of withdrawal, how to exercise this right, and the official authorities where they can submit complaints and objections, clearly, understandably, and in accordance with the internet environment, that they have confirmed this preliminary information electronically, and that they subsequently ordered the accommodation service in accordance with these terms.
The preliminary information on the sapancaohoibungalow.com site and the invoice issued upon the BUYER's request are integral parts of this agreement.
Article 3- Details of the Product/Payment/Delivery
The accommodation service purchased electronically, sales price, payment method, persons to stay, accommodation address, invoice information are as follows. The person to be invoiced must be the same as the person who made the contract. The information below must be accurate and complete. The buyer accepts to cover all damages that may arise from incorrect or incomplete information and also accepts all responsibilities that may arise from this situation. The SELLER reserves the right to terminate the service if the information provided by the BUYER is not accurate. The SELLER has the right to cancel the reservation if additional persons not mentioned or persons other than those specified come.

Article 4- Contract Date and Force Majeure
The contract date is the date when the reservation is made by the buyer.
Situations that were not present or foreseen at the time of signing the contract, that develop beyond the control of the parties, and that make it impossible for one or both parties to partially or completely fulfill their obligations and responsibilities undertaken by the contract or to fulfill them on time will be considered as force majeure (natural disasters, war, terrorism, uprisings, changing legislative provisions, seizure or strike, lockout, significant malfunctions in production and communication facilities, etc.). The party facing force majeure will immediately notify the other party verbally. During the continuation of force majeure, the parties will not have any responsibility for not fulfilling their actions. If this force majeure situation continues for 30 (thirty) days, each party will have the right to unilaterally terminate the contract.
Article 5- Rights and Obligations of the Seller
5.1. The seller accepts and undertakes to fulfill the obligations imposed on them in the contract in accordance with the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, except for force majeure.
5.2. Persons under the age of 18 cannot make reservations on www.sapancaohoibungalow.com. The buyer declares that they are over 18 years old by making a reservation on the website. The seller cannot be held responsible in any way for the actions of a user under the age of 18 who makes a reservation on www.sapancaohoibungalow.com.
5.3. www.sapancaohoibungalow.com is not responsible for price errors resulting from system failures. Accordingly, the seller is not responsible for any promotional, price errors that may arise due to system errors, design, or illegal interventions on the website. The buyer cannot claim any rights from the seller based on system errors.
5.4. Purchases can be made on www.sapancaohoibungalow.com by credit card (Visa, MasterCard, etc.) or bank transfer. Reservations not transferred within 1 business day from the reservation date are canceled. The reservation processing time is not the moment the order is placed, but the moment when the necessary amount is collected from the credit card account or the transfer (EFT) reaches the bank accounts. Payment methods made without consulting customer service, such as COD or postal check, are not accepted.
5.5. In reservations to be paid by bank transfer or credit card, the transfer, EFT, credit card payment information is provided to the Seller, and confirmation is requested from the SELLER. The seller cannot be held responsible for delays caused by the buyer not informing the seller despite having made the payment. Unconfirmed reservations will not be processed.
5.6. The visual information on the website is entirely for the convenience of customers, and the appropriateness of the published data is entirely at the discretion of the buyer. The seller's preliminary information does not constitute a guarantee.
5.7. There may be color, size, and text differences between the accommodation area seen in the visual and the website images due to the web environment.
5.8. If www.sapancaohoibungalow.com provides a direct link to another website, all responsibility for the content and use of the link lies with the user, and www.sapancaohoibungalow.com has no responsibility for the content and use of the link.
5.9. All images on www.sapancaohoibungalow.com cannot be used by the user for any reason or commercial purpose.
5.10. In the event of a price change during the purchase on the www.sapancaohoibungalow.com website, the final pricing will be the prices seen in the reservation confirmation.
5.11. www.sapancaohoibungalow.com websites work best with Google Chrome web browser. The seller is not responsible for errors related to transactions and displays made from other web browsers.
Article 6- Rights and Obligations of the Buyer
6.1. The buyer accepts and undertakes to fulfill the obligations imposed on them in the contract in full, except for force majeure.
6.2. The buyer accepts and undertakes to make the payment in accordance with the payment method specified in the contract by making a reservation.
6.3. The buyer accepts and declares that they have been informed about the seller's name, title, full address, phone number and other access information, basic qualities of the service subject to sale, sales price including taxes, payment method, delivery conditions and costs, etc., and all preliminary information about the service subject to sale, as well as the right of withdrawal, how to exercise this right, and the official authorities where they can submit complaints and objections, clearly, understandably, and in accordance with the internet environment, that they have confirmed this preliminary information electronically.
6.4. In connection with the previous article, the buyer declares that they have read the www.sapancaohoibungalow.com reservation/payment/use procedure information, which includes reservation and payment conditions, house usage instructions, measures taken against possible situations, and warnings, and that they have provided the necessary confirmation electronically.
6.5. If the buyer wants to cancel their confirmed reservation, the full amount paid will be refunded by the SELLER if the cancellation is made up to 15 days in advance. If the cancellation is made less than 15 days before the reservation, half of the amount paid will be refunded. The buyer accepts, declares, and undertakes to make a reservation under these conditions.
6.6. The buyer is obliged to leave the house items as they were delivered. The buyer accepts, declares, and undertakes that they will pay for any damages caused by their fault during the accommodation period. If any damage is detected after the check-out and requested by the SELLER, the buyer is obliged to make the payment without objection.
6.7. The buyer cannot accept any guests other than the persons notified during the reservation.
Article 7- Right of Withdrawal Procedure
For the service purchased on www.sapancaohoibungalow.com, the right of withdrawal applies under the following conditions.
After the reservation is confirmed, the buyer has the right to cancel the reservation without any condition by exercising the right of withdrawal up to 15 days before the accommodation start date. If the buyer applies to the seller 15 days in advance to exercise the right of withdrawal, the seller will:
- Refund the full amount if the reservation fee was fully paid.
- Refund half of the amount if half of the fee was paid.
- Refund the deposit if only a deposit was taken.
If the right of withdrawal is exercised within a shorter period than 15 days, the seller will:
- Refund half of the reservation fee if the full amount was paid.
- Not refund any amount if half of the fee was paid.
- Not refund the deposit if only a deposit was taken.
Article 8- Confidentiality
The information specified in this contract and the information provided by the buyer to the seller for payment purposes will not be shared with third parties by the seller.
The seller can disclose this information only within the framework of administrative/legal obligations. The seller can provide the requested information to the relevant authority if there is a documented investigation competence. Credit card information is not stored. Credit card information is only used securely to transmit the necessary information to the relevant banks during the collection process and is deleted from the system after the authorization.
The buyer's email address, postal address, and phone number are only used by the seller for standard delivery and information procedures. In case of a violation of the site's security or usage conditions by the user that constitutes a crime, the relevant information for the identification and prosecution of the person will be shared with the security forces.
Article 9- Authorized Courts and Enforcement Offices in Case of Dispute
In case of disputes arising from the implementation of this agreement, the Consumer Arbitration Committees up to the value announced by the Ministry of Industry and Trade in December each year, and the Consumer Courts in the place of residence of the buyer or seller are authorized. In commercial matters not covered by the Consumer Protection Law No. 6502, the Sakarya Courts and Enforcement Offices will be authorized and competent.
In case of an order, the buyer is deemed to have accepted all the terms of this agreement.
